Construction Warranty Claims
The Homeowner Protection Act establishes specific rules for residential home builders. Enacted in 1998 after claims following the leaky condominium crisis, the Act includes licensing and warranty requirements.
At Lesperance Mendes, we primarily assist strata corporations and homeowners with claims against warranty providers and builders in violation under the Homeowner Protection Act.
The Homeowner Protection Act requires licensing of builders and warranty coverage by builders for condominiums and residential homes. Warranties must provide the following coverage:
- Ten years for structural defects
- Five years for the building envelope, including water penetration
- Two years for materials and labour
Partner and founder John Mendes oversees our construction defect practice group, bringing both legal experience and knowledge.
Our lawyers represent clients who have moved into new homes and discovered serious defects. We help them to resolve their claims through mediation, arbitration, or, where necessary, and litigation.
